ADU Rental Income in Arcadia, CA
What it takes to rent out a backyard unit legally in California — permits, occupancy rules, the 30-day line and taxes — and which construction decisions actually move what the unit earns.

BEFORE YOU CAN RENT
Four things have to be true before a unit can be rented.
Renting out a backyard unit in California is mostly a permitting question, not a construction one. Get these four right and the rest is ordinary landlord work.
It has to be permitted
A unit without a permit is not a legal tenancy. It cannot be advertised as a dwelling, it usually will not count in an appraisal, and an insurer can decline a claim that involves it. The route to a rentable unit ends at a final inspection and a sign-off — not at a finished room.
Nobody has to live on site
AB 976 (2023) bars any California city or county from imposing owner-occupancy on an ADU. You can let the ADU and the main house to two separate households.
The tenancy has to run longer than 30 days
Cities may require ADU tenancies of more than 30 days, which rules out short-term and vacation letting. This is the one occupancy rule that still bites.
A JADU with a shared bathroom is different
Under AB 1154 (effective January 1, 2026) a city may require the owner to live in the main house or the JADU where the JADU shares sanitation facilities with the house. Give the JADU its own bathroom and that requirement cannot be imposed.
These four are the ones that stop a rental. They are not the only rules — setbacks, parking, size and utility capacity are decided locally and are covered in the pages linked below.
STATE LAW
The California rules that decide whether you can rent it out.
On smaller screens, swipe across the table to compare all columns.
| Rule | What it does | What it means for a rental |
|---|---|---|
| AB 976 (2023) — owner-occupancy | Prohibits local agencies from requiring an owner to live on the property as a condition of an ADU. | The house and the ADU can be let to separate tenants. |
| AB 1154 (from 1 January 2026) — JADUs | A city may require owner-occupancy only where a JADU shares sanitation facilities with the main house. | A JADU with its own bathroom is treated like an ADU. One without is not. |
| 30-day minimum | Local agencies may require rental terms longer than 30 days for both ADUs and JADUs. | No short-term letting. Plan the finances around a long tenancy. |
| SB 543 (from 1 January 2026) — fees and process | No impact fees on an ADU of 750 sq ft or less of interior livable space; proportional fees above that; none on a JADU. Written completeness decision within 15 business days. | Smaller units carry materially lower fees, and size is measured inside the walls rather than to their outside face. |
| AB 1033 (2024) — separate sale | Lets a city opt in to allowing an ADU to be subdivided and sold as a condominium. | An exit option in the cities that have adopted it. Relatively few have. |
| Civil Code § 4751 — HOAs | Voids any covenant or restriction that effectively prohibits or unreasonably restricts an ADU or JADU. | An HOA cannot refuse the unit. It can still impose reasonable exterior standards. |
Zoning, parking, utility capacity and fire access are decided locally and property by property. Confirm current requirements with the City of Arcadia before you commit to a plan. If the unit already exists without permits, read our guide on legalizing unpermitted work in Arcadia first.
WHAT MOVES THE NUMBER
What actually determines what a unit can earn.
We are builders, not letting agents, and we do not publish rent estimates. A market rent is a number your agent or your lender should give you from comparable lettings, not a number from a contractor. What we can tell you is which construction decisions change that number — because those are the ones you only get to make once.
Bedroom count and usable area
The single biggest driver. A studio and a one-bedroom on the same lot are two different products with two different tenant pools.
A separate, private entrance
Tenants pay for an address of their own, not for a door off the main hallway. The entrance position is decided on the site plan, not after framing.
Parking
Where a city requires a space, or where the street simply has none, it changes who will rent the unit. No parking is required when the unit is within half a mile of transit, is a conversion of existing space, or replaces a garage or carport being converted.
In-unit laundry
A washer and dryer inside the unit is routinely the difference between a short let and a long tenancy. It is a plumbing decision made at rough-in.
Private outdoor space
A small court or yard of its own turns a room into a home. It costs nothing to allocate on the plan and is almost impossible to add later.
Light, ventilation and acoustic separation
Ceiling height, window placement, and the build-up of the wall between the unit and the house. The last one is what tenants complain about, and it is buried behind plaster by the time it is noticed.
Two of these — the private entrance and the acoustic separation — cannot be retrofitted cheaply. Decide them at design stage, during the checks described on our ADU builder page.
THE MONEY
What it costs to get there, and what it costs to keep.
Getting there
The build cost is the largest line, and it is set out in full on our ADU cost page. Two points belong here. Fees are lower than most owners expect on a small unit, because state law bars impact fees on an ADU of 750 sq ft or less of interior livable space. And converting existing space is usually the cheapest route to a rentable unit, because the shell, the slab and the roof are already there — see garage conversion ADUs.
Keeping it
| Item | What to expect |
|---|---|
| Property tax | An ADU does not trigger a full reassessment of the house. The county assessor adds the value of the new construction to the existing assessed value, which stays where it is. How much depends on what you spend. |
| Insurance | Tell your carrier the day the permit is final. An unpermitted or undeclared unit is one of the most common reasons a claim is refused. |
| Maintenance | A second kitchen and bathroom is a second set of systems to service. Budget for it the way you already budget for the main house. |
| Rent rules | State law does not set rent limits on an ADU. Local tenant protection and rent stabilisation ordinances can still apply to the tenancy itself. |
How owners fund the build is a separate question — ADU financing options in California covers the routes people actually use.
WHO DOES WHAT
Design, permits and construction: who is responsible for what.
This is the part that most often gets muddled, so we state it plainly. KWA Home is not an architecture or design firm. We do not offer architectural design to the public, and we do not stamp drawings. What we do is coordinate the work and build it.
Drawings
Prepared and stamped by licensed design professionals — a California-licensed architect, as the scope requires. We coordinate that work, the site information it depends on, and the revisions the city asks for.
Permits
Submitted through the city portal and tracked. Arcadia runs a pre-approved ADU plan programme (PAADU) for detached units: a pre-approved plan removes Planning review and shortens plan check, and it must be used together with the designer who owns it.
Construction
Our scope, under CSLB #1145730 — structure, framing, mechanical and electrical rough-in, insulation, finishes, inspection at each hold point, and handover.
Materials and cabinetry
Specified before demolition and supplied through our own manufacturing, so the palette is decided up front rather than improvised on site mid-job.
If you need a feasibility answer before you spend money on drawings, ask for that first. The checks on our ADU builder page are what decide whether a rental unit is realistic on your lot at all.
HOW IT RUNS
How a rental ADU project runs, stage by stage.
Feasibility
Lot, setbacks, utilities, parking and access. No drawings yet, and nothing spent on design until the site supports it.
Design and drawings
A licensed design professional produces the permit set while we fix scope, materials and finishes alongside it, so the palette is settled before anything is demolished.
Permits
Submitted through the city portal and tracked. Review is ministerial — the city checks the plans against objective standards. Where it does not act inside the statutory window an application can be deemed approved; confirm the current rule with the city.
Build and handover
Site work, structure, services, insulation and finishes, inspected at each hold point, then final sign-off and the paperwork a tenancy needs: appliance information, shut-off locations and warranty documents.
FAQ
Questions Arcadia owners ask about renting an ADU.
Can I rent out an ADU in Arcadia?
Yes, once it is permitted and signed off. State law bars cities from requiring you to live on the property. Cities may require tenancies longer than 30 days, so plan for a long let rather than a short one.
Can I rent both the house and the ADU?
For an ADU, yes — that is what AB 976 allows. For a JADU that shares a bathroom with the main house, a city may still require the owner to live in one of the two.
Can I use it as a short-term rental?
Assume no. State law lets cities require rental terms longer than 30 days for both ADUs and JADUs, and most do.
Can I rent a unit that was built without permits?
Not legally. It has to go through the permit process first, which is a different job from building it. See legalizing unpermitted work in Arcadia.
Do I have to live on the property?
Not for an ADU. That requirement was removed statewide by AB 976, and no local agency can reinstate it.
Will my property taxes go up?
The assessor adds the value of the new construction to your existing assessed value; the house itself is not reassessed. How much depends on what you spend and on the value the unit adds.
Can my HOA stop me?
No. Civil Code § 4751 voids any covenant or restriction that effectively prohibits or unreasonably restricts an ADU or JADU. Reasonable exterior standards can still apply.
Can I sell the ADU separately from the house?
Only in a city that has opted in under AB 1033, and relatively few have. Ask the city before you plan around it.
Do I need to provide parking?
Often not. No parking is required where the unit is within half a mile of transit, is a conversion of existing space, or replaces a garage or carport being converted. We check your address during feasibility.
Will an ADU force fire sprinklers into my house?
No. An ADU needs sprinklers only if the main house already has them, and building one does not trigger a retrofit of the house.
